Vesteda Camera Surveillance Protocol

To ensure the safety of residents and visitors, Vesteda has drawn up a ‘CCTV Protocol’. This sets out the agreements and rules we follow when using cameras in our residential complexes, with respect for everyone's privacy.

Please note: the Vesteda camera protocol does not apply to buildings in which a camera protocol has been established in cooperation with the residents.

In order to inform residents quickly and clearly, we have also drawn up a Q&A. Here you will find answers to the most frequently asked questions, including situations in which a Homeowners’ Association (Dutch: VvE) is responsible for camera surveillance.

Why camera surveillance?

Why are there cameras at Vesteda complexes?

Vesteda uses camera surveillance to ensure the safety of residents, visitors and its property. It helps to prevent incidents such as burglary, vandalism and unauthorised access.

What is the legal basis for camera surveillance?

Vesteda bases its camera surveillance on its legitimate interest, as referred to in Article 6(1)(f) of the General Data Protection Regulation (GDPR). In doing so, we have carefully weighed how we protect the privacy of residents and visitors.

Is sound also recorded with camera surveillance?

No, the system only records images. No sound recordings are made.

Where are the cameras located and how will I be informed?

Where are the surveillance cameras located?

Cameras are located at strategic points in and around the complex, such as entrances, corridors and bicycle sheds. No cameras are installed in private areas, such as homes or storage units.

How do I know that there is camera surveillance?

Vesteda informs residents in advance in writing. In addition, warning stickers or signs have been placed in visible locations.

Are the camera recordings viewed live?

No, recordings are not monitored continuously. Footage is only viewed in the event of an incident or at the request of an authorised agency.

Who manages the system?

Who is responsible for the camera surveillance?

Vesteda is responsible for the management, maintenance and security of the camera system. It may outsource technical management to a specialised party, with whom it has reached clear agreements.

What happens in the event of a malfunction with the camera surveillance?

Vesteda checks the system periodically. Any malfunctions are rectified as quickly as possible.

Are the costs of the camera surveillance passed on to tenants?

Yes, the costs of camera surveillance are part of the service package.

Access to footage

Can I view surveillance footage in which I appear?

Yes, you have the right to access the footage pursuant to the GDPR. Vesteda will carefully assess your request and weigh your interests against the privacy of others in the footage.

Can I get a copy of the surveillance footage?

No, you can only view the footage. A copy will not be provided unless required by law or with the consent of all parties involved.

Can I request suveillance footage if I am the victim of an incident?

Yes, if you have reported the incident to the police and give a clear description of the incident (date, time, location), you can request access. Vesteda will then weigh the interests involved.

How does access to the surveillance footage work?

You are given access at a Vesteda location, in the presence of the Vesteda Management Board. You will be asked to provide proof of identity and sign an access declaration in which you promise to treat the information confidentially.

What if I am accidentally captured on camera?

Vesteda only views footage when strictly necessary. Your privacy is always taken into account.

Security and retention period

How long does Vesteda retain surveillance camera images?

Footage is retained for a maximum of four weeks. If an incident has been reported, the images are retained for up to four weeks after the incident has been dealt with. A different period applies in the event of a police investigation.

What happens after the retention period with the surveillance footage?

Footage is automatically deleted unless it is needed for an ongoing investigation.

How is the security footage secured?

Vesteda has taken technical and organisational measures, such as encryption, access management and logging. These are evaluated on a regular basis.

Who has access to the camera images?

Only authorised employees or external parties with a processing agreement have access, and only when necessary.

Is camera footage shared with external parties?

Vesteda only provides the police, judicial authorities or other competent authorities with footage, and then only on a legal basis.

Rights and complaints

What are my rights regarding camera surveillance as a resident or visitor?

You have the right to access, object to and restrict processing. You can submit your request via privacy@vesteda.com.

Can I object to camera surveillance?

Yes, you can do so via the same email address. Vesteda will carefully assess your objection.

Where can I go with any questions or complaints regarding camera surveillance?

You can send an email to privacy@vesteda.com. If you are unable to resolve the issue with Vesteda, you can contact the Dutch Data Protection Authority (Autoriteit Persoonsgegevens), or file legal proceedings.

Homeowners’ association complexes

Does this camera surveillance protocol apply to all Vesteda complexes?

No, this Protocol does not apply to complexes that are not wholly owned by Vesteda and where there is a homeowners’ association. In that case, the homeowners’ association is responsible for camera surveillance.

Where can I go with any questions or complaints about camera surveillance if my complex has a homeowners’ association?

In that case, you can contact the homeowners’ association with any questions, complaints or requests for additional information about camera surveillance.
